Introduction

In the social context, dividing men and women into separate cells and making separate lists of their rights and duties is tantamount to dividing a human being into separate sections. The fact is that men and women together form a complete human being and their interdependence and cooperation is the guarantee of social existence, evolution, peace, tranquility and comfort but it is a sad fact that If we look at human history in terms of women, the whole history is full of bloody stories of women being oppressed.
For the first time in human history, Islam gave woman equal status with man, but in honor and respect, woman gave priority to man over man. And He placed Paradise under the feet of the one who was buried alive immediately after birth.

Islam spread very fast all over the world. They acknowledged the supremacy of a new religion and a new civilization, but did not have the proper training to adapt themselves to the social requirements of that religion, nor did they have the inward readiness to follow their centuries-old traditions and ancestors. How to shake off the hereditary superstitions and settle in a new environment and new world, soon conscious efforts were made to prove that Islam ie Qur'an and Sunnah also give less status to women than men. Therefore, many verses According to Iqbal: According to Iqbal:

They do not change themselves. They change the Qur'an

Such efforts will be briefly mentioned below and then the position of women will be highlighted according to the Qur'an and Sunnah.

The reality of misconceptions about women:

Woman born of man's rib

It has been known since ancient times that a woman is born of a man's rib, so she is weaker and inferior to a man. It can be based on the statement of the Bible. In addition, the verse of the Qur'an al-Hakim: 3]) (Woman is like a rib) is also presented in this regard.

The fact is that there is no mention in the Qur'an al-Hakim that a woman is born with a rib. In fact, there was a metaphor in ancient literature which the Prophet (peace be upon him) stated that a woman is like a rib in flexibility.

The aforesaid part of the Qur'anic verse and its context do not testify to ribs. The second place comes:

وَمِنْ آيَاتِهِ أَنْ خَلَقَ لَكُمْ مِنْ أَنْفُسِكُمْ أَزْوَاجًا. ([4])

"And of His Signs is that He has created for you pairs of yours."

The Cell Theory of modern science concerning human life  also explains this statement.

The woman caused the exit from heaven

According to the biblical account, both Adam and Eve were living happily in paradise when Eve seduced Adam into eating the tree that caused them to come out of paradise. [6] In that sense, the woman was weak. Is. The Qur'an al-Hakim denied the allegation and said:

وَعَصَى آدَمُ رَبَّهُ فَغَوَى. ([7])

And Adam disobeyed his Lord and strayed from the right path.

Nowhere in the story of Adam and Eve does the Qur'an accuse Eve, but mentions both of them being seduced by Satan.

The husband rules over the wife

In order to prove the superiority of man over woman, it was argued from this verse of Qur'an al-Hakim: الرَّجَالُ قَوَّامُونَ عَلَى النِّسَاءِ. ([9]) Women are included in their subjects, whereas in Arabic, Qawam means a person who is obliged to run the affairs of an individual, organization or system properly, to protect and guard it and to provide for its needs. Yes, this concept is accepted by lexicographers. This meaning is clear from many verses of the Qur'an.

Because the man is physically strong and does not face the responsibilities and disorders that women have to bear in childbirth, the protection and provision of necessities is considered to be the responsibility of the man. Due to this, he got a sinful superiority while the Qur'an Al-Hakim established a balance by giving superiority to woman over man in respect and dignity.

وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَتُوا بِأرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً. [12]

"Those who slander chaste women and cannot produce four witnesses should be given eighty (80) lashes."

The punishment has been meted out to those who abuse women by giving them superiority in honor and dignity.

It is permissible to kill the wife

The Qur'an al-Hakim states:

وَاللَّاتِي تَخَافُونَ نُشُوزَهُنَّ فَعِظُوهُنَّ وَاهْجُرُوهُنَّ فِي الْمَضَاجِعِ وَاضْرِبُوهُنَّ فَإِنْ أَطَعْنَكُمْ فَلَا تَبْغُوا عَلَيْهِنَّ سَبِيلًا إِنَّ اللَّهَ كَانَ عَلِيًّا كَبِيرًا۔([13])
....
"Explain to men who are afraid of their wives, then separate them in beds, then kill them. If they obey, don't look for excuses to abuse them."

By justifying this verse, men opened the door of violence against women on the slightest thing and started presenting this verse to justify their oppression. It is necessary to see what is the meaning of this verse:

1. These rulings are related to the aspect of the pure private and private life of the spouses in which no one else is aware of their relationship. Before informing the family about their bedroom matters.

2. The aforesaid punishment is related to the crime of Nashwaz. There are different levels of addiction. The Prophet (peace and blessings of Allaah be upon him) explained the degree to which it is permissible to reprimand one's wife in the presence of more than one hundred thousand Companions on the occasion of the Farewell Hajj, in which he said:

"You have a right on your wives not to invite anyone else to your bed whom none of you like. If they do, rebuke them, but be careful not to injure them. "([14])


3. If the wife has to be reprimanded for the above reason, she should not be beaten in such a way as to cause injury or bruise on her body and not on the head, face and delicate limbs. It has to make him feel guilty. It should be noted that reprimanding a wife is not a desirable act from an Islamic point of view. Is.

4. If the husband tortures the wife, beats or insults her for any reason other than the aforesaid offense, or does not pay alimony, or the husband suffers from moral depravity, then the wife has the right to be separated from him through legal action.

The woman's share has been kept low

When a woman is inferior, it is also argued that the Qur'an has reduced her share in inheritance.

If the division of inheritance and the economic responsibilities of men and women are seen face to face, then woman has no financial responsibility of any kind, neither of herself nor of anyone else. In addition to their responsibilities, they also provide for their wives, children, parents and in some cases siblings.

Half the testimony of a woman

It has been argued that the Qur'anic injunction equates the testimony of two women with the testimony of one man:

فَإِنْ رَجُلِينَ َْمْرَأَتَانِ مِنَ ال الشُّهَدَاءِ ََنَ تَضِلَّ ِْحْدَاهُم 15.

"If there are no two men to testify, make one man and two women of your choice witnesses so that if one forgets, the other will remind him."

The interpretation of this verse is confused with being a witness (a sudden event occurs and the people present automatically become witnesses) and making a witness on a document. The verse has to do with being a witness, not automatically becoming a witness Is. This verse does not relate to the judicial evidence of an event but to the protection of the right of the creditor, for which:

* Preparing documents. * Making witnesses. * Mortgages.

And many other instructions have been given, otherwise the whole ummah agrees that the testimony of only one woman in the labor room proves to be genocide. The two men and women who had become husband and wife were separated.

Hanafi jurists have explained in almost all the amahat al-kitab that the reason for not accepting the testimony of women in Hudood, for example, is not lack of their knowledge, intellect or religion but their respect requires that they not be dragged to the courts.
